The introduction of the duty to take reasonable care not to make a misrepresentation represents one of the most significant reforms to Australian insurance law in recent years. This seminar will examine how the new duty applies in the life insurance context, including recent AFCA decisions and their practical implications for insurers, policyholders and practitioners. It will also explore how Australian courts may interpret the duty by reference to the statutory factors in the Insurance Contracts Act and comparable UK jurisprudence, offering practical guidance on the likely direction of judicial interpretation and the issues to be aware of as this area of law continues to develop.
